About

The Orr Road Cooperative (ORC) is intended to provide a safe, organized, and legitimate series of bicycle training rides in Charlotte, NC utilizing local roads and municipally approved business park locations within the city, and in coordination with the interests and well­being of the local bicycling community, and the city of Charlotte at large. The primary ORC ride and venue will be the Tuesday Night Training (TNT) ride at the General Commerce Center industrial park located on Orr Road in Charlotte, NC.

Code of Conduct

This code is no more than a formalization of the basic principles of decency, road safety and common sense that the ORC expects from all its members and covers how its members should act when riding on any ORC ride. The ORC also expects its members to respect all aspects of the Code affecting other road users when riding.

As a member of “Orr Road Cooperative” (hereinafter “ORC”), I will practice good sportsmanship and conduct myself in a professional manner at all cycling and non­cycling events where I am representing the club.

 

Responsibilities

When you get on your bike you take on a responsibility, to yourself and to others. When you part of a group such as ORC, that responsibility is magnified. Ride responsibly, obey traffic rules, don’t block traffic. In short, be good steward’s of cycling. You are expected to act as a positive representative for the sport of cycling, our sponsors, supporters, and the community at large. ORC members will act and behave in a sportsmanlike and professional manner while representing the ORC. ORC members are required to volunteer at least twice per season at rides and/or other events that the ORC may put on. Rider rules can be found at www.orrroad.com.

Supporters & The City of Charlotte

The ORC and its activities are made possible by its members, its supporters, sponsors, and The City of Charlotte. At least in concept, it's a symbiotic relationship. Spread the word. Be a loyal ambassador and an evangelist. Whenever someone asks ­ and sometimes even if they don’t ­ show some appreciation by talking up ORC supporters, sponsors, and The City of Charlotte. Take the time to educate other local riders. Provide useful feedback. If your experience helps improve the local community and its citizens, as an ORC member you have made a difference. Most of all, be a nice person. Never forget that being a part of a community group like ORC carries with it the responsibility to represent it and your fellow members with dignity.

Safety

ORC members must be conscious of their role as ambassadors to the non­cycling and recreational cycling community. Failure to abide by traffic laws, if observed by the public, can be extremely detrimental to the ORC and its community relations, and may result in the withdrawal of support from ORC advocates, sponsors, and the City of Charlotte. ORC members agree to obey all traffic regulations as enforced by all relevant local authorities while on individual, group or ORC training rides, or as instructed during other cycling related events.

Unacceptable Behavior

Unacceptable behavior can result in your expulsion from the ORC. Unacceptable behavior includes but is not limited to:

  1. Not adhering to the ride and organization rules, regulations, and directives of the ORC.

  2. Use of foul language or physical abuse towards any person while representing the ORC.

  3. Making obscene gestures directed to any persons while participating in a ride or training event.

  4. Malicious actions on or off the bicycle toward any persons, property, or ORC equipment.

  5. Disprecting the ORC, members, supporters, sponsors, or The City of Charlotte on sites such as: Facebook, Twitter, Instagram or other social media.

Dismissal

Orr Road Cooperative reserves the right to revoke a membership at any time for conduct detrimental to the image of the ORC or safety of its members. Members demonstrating a manifest unwillingness to meet the above Code of Conduct will be subject to suspension or dismissal from the ORC without reimbursement of cost. Your removal from the ORC is at the discretion of ORC leaders if Code of Conduct is not followed, according to the process outlined in the ORC Articles of Organization. Anyone found to be in consistent violation of proper conduct can and will be removed from the ORC.

Waiver & Release of Liability

IN CONSIDERATION of being permitted to participate in such activities as may now or hereafter be organized, operated, sponsored, and/or promoted by Orr Road Cooperative (hereinafter “ORC”), the undersigned hereby represents and agrees as follows:

  1. The following release is intended to benefit and shall be deemed to extend to and cover, without limitation, the following entities or persons: “Orr Road Cooperative” or ORC, its officers, directors, managers, members, employees, agents, contractors, and subcontractors, as well as any and all ORC representatives, sponsors, municipalities, event directors and volunteers, their heirs, successors in interest, assigns and insurers (“Releasees”); and,

  2. I hereby acknowledge that the risk of injury from the activities involved in this program is significant, including the potential for property loss, serious bodily injury, permanent paralysis and/or death. Such risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, equipment, vehicular traffic, conditions of athletes, lack of hydration, and actions of others, including, but not limited to, Releases, ride participants, members, sponsors, volunteers, spectators, coaches, event officials and monitors, and producers or promoters of rides and training events. I also realize that various situations that may give rise to liability for serious personal injury and/or property damage may arise from the negligence or carelessness of the various persons and/or entities being released hereby, or from dangerous or defective equipment or property owned, maintained or controlled by them; and,

  3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS OF PARTICIPATING OR VOLUNTEERING IN SUCH ACTIVITIES, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

  4. I certify that I am physically fit, have sufficiently trained for participation in these activities and have not been advised otherwise by a qualified medical practitioner. I acknowledge that this Waiver and Release of Liability (aforementioned “Waiver”) may be used by event holders, sponsors and organizers, in which I may participate, and that it will govern my actions and responsibilities at said activities; and,

  5. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the ORC immediately; and,

  6. I hereby consent to the provision of emergency medical treatment which may be deemed advisable in the event of injury, accident or illness which may occur while participating in any such activities. In the event of injury I further consent to the provision of such transportation arrangements as may be required in order to effect emergency medical treatment as well as the release of any and all information that may be required in order to provide reasonable and necessary medical treatment on my behalf; and,

  7. I, for myself and on behalf of my heirs, next of kin, executors, personal representatives, successors, administrators, transferees, and assigns, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS the entities and/or individuals listed above (“Releasees”) from any and all liabilities and/ or claims, INCLUDING INJURY, DISABILITY, DEATH, or loss or damage to person or property which may result or derive in any way from my participation in the activities, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law; and,

  8. I understand and expressly agree that the aforementioned Waiver is intended and shall be construed to be as broad and inclusive as is permitted by the laws of the State of North Carolina, and that if any portion thereof is held invalid, it is agreed that the remainder of the Waiver shall, nevertheless, continue in full force and effect, without abatement of the remaining terms thereof. I further represent and warrant that I am over the age of 18 or have parental or guardian consent and that I have carefully read this Waiver and understand its terms. I understand that I am giving up important and substantial legal rights, including but not limited to the right to sue and/or recover legal damages from the individuals and/or entities released hereby. I further acknowledge and represent that I am signing this Waiver freely and voluntarily, with the intent to be bound by the terms of this Waiver to the fullest extent allowed by law; and,

  9. I hereby release, discharge and covenant not to sue ORC, its organizers, administrators, directors, agents, officers, members, volunteers, and employees, other participants, and sponsors, advertisers, and, if applicable, owners and lessors of premises on which activities/rides/events take place, (each considered one of the RELEASEES herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the RELEASEES or otherwise, including negligent rescue operations; and I further agree that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my/our behalf, makes a claim against any of the RELEASEES, I will indemnify, save, and hold harmless each of the RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
